§ 3. Mayor and Town Council.

  • (1)

    The Mayor of the Town shall be elected for a term of two (2) years pursuant to G.S. 160A-101(8)(a). The Mayor shall only have the right to vote on matters coming before the Council in order to break a tie.

    (2)

    The number of members of the Town Council shall be five (5). The terms of office of the Council members shall be two (2) years.

    (3)

    All candidates for the Council shall be nominated and elected by all the qualified voters of the Town pursuant to North Carolina General Statute 160A-101(6)a. The Mayor shall also be elected by all qualified voters of the Town.

    (4)

    All elections conducted within the Town of Atlantic Beach for the election of Councilmembers and Mayor shall be on the basis of nonpartisan elections held in November, biennially in odd-numbered years on the day set by general law for municipal elections.

    (5)

    Each voter shall be entitled to vote for one (1) candidate for Mayor and for five (5) candidates for Councilmember. The candidate for Mayor who receives the largest number of votes cast for Mayor shall be declared elected. The five (5) candidates for Councilmember who receive the largest numbers of votes cast for Councilmember shall be declared elected.

    (6)

    The Town Council may, by ordinance, policy, or practice establish positions for various Town officers and employees and define the duties and functions of such officers or employees, and the compensation, or range of compensation, for such officers and employees.
